Terms and Conditions of Euroleague Basketball Devotion Mobile Service.

By subscribing to the Euroleague Basketball Devotion Mobile Service ("the Service"), the user accepts the following terms and conditions:

The content of the Service is owned by Euroleague Properties NV (hereinafter referred to as EP), a company incorporated in the Netherlands. EP’s registered office address and postal address is Baronielaan 139, 4818 Breda, theNetherlands. It is protected by copyright, database rights, trademark rights and other intellectual property rights. Any reproduction, copy or publication of the content of the Service without EP's prior approval is strictly prohibited.

The Service is provided by Fullsix Spain, a company incorporated in Spain. Fullsix Spain’s registered office address and postal address is Alcalá 265, Edif. 2, 2a planta, 28027 Madrid, Spain.

The user agrees and accepts that the Service is for his/her own personal use and may not be used for commercial purposes, whether revenue generating or not, and may not be further distributed in any way.

EP and Fullsix Spain will respect the confidentiality of the personal data that the user has provided in the subscription form in compliance with the personal data protection regulations in force. In order to provide the Service, it will be necessary for EP and/or Fullsix Spain to send the user’s personal datato third parties engaged by EP and/or Fullsix Spain to provide the Service. EP will not deliver this information to any other parties. By accepting these terms and conditions, the user agrees that EP and/or Fullsix Spain may send to the user information by e-mail or text message relating to the Euroleague Basketball Devotion Mobile Service. The information that will be provided voluntarily in the subscription form will be included in the Euroleague Basketball Newsletter database, which is owned by EP,for the purposes of sending to the users newsletters and information about the promotions launched by Euroleague Basketball together with its sponsors. The user can exercise his/her rights to access, correct, cancel or disagree with the information with which the user has provided EP, by writing to EP to the above-mentioned address, or to contact@euroleaguemobile.net, clearly indicating his/her name, surname and address.

EP andFullsix Spain will not be liable to the user for failures, delays or defects in the delivery of the content that are caused by factors outside EP andFullsix Spain’s control. This includes wrong or incorrect information supplied by the user. EP andFullsix Spain will try to make sure that the content reaches the user in a timely manner. However, sometimes this may be affected by factors outside EP and/orFullsix Spain’s control, for example interruptions to EP and/orFullsix Spain services due to faults in mobile networks or third party suppliers. EP andFullsix Spain will not be liable for any delay caused by them. It is the user’s responsibility to ensure that his/her device and network are capable of receiving the Service. Picture and messages must be downloaded within 30 days of purchase, after which the link will be inactive. Connection to the WAP portal for downloading the pictures is not including in the price of the packages and should be cover by the user. All liabilities to the user in relation to the Service are limited to the amount that the user has paid for his/her subscription.

EP andFullsix Spain will not be liable to the user for any damages to the mobile of the user that are derived from the access to the Service.

EP andFullsix Spain reserves the right to alter the Service and the content of messages at any time and at its entire discretion. Should this right be exercised by EP andFullsix Spain, it will provide a reasonable alternative. The Service and networks may from time to time require upgrading, modification, maintenance or other works. These may result in some or all of the Services becoming temporarily unavailable. In such cases, EP andFullsix Spain will use reasonable efforts to maintain the period of non-availability to a minimum. However, some interruption may be inevitable.

If the user uses the Service from a country outside Spain, his/her use may be subject to additional local costs and to local laws and regulations. EP and/orFullsix Spain are not liable for any such additional costs or such local laws or regulations.

If there is any error, defect, interruption, malfunction or delay in the provision of the Service, the user should notify EP andFullsix Spain of the fault by sending an e-mail to contact@euroleaguemobile.net, marking the subject field 'Fault'. To the extent that the fault is under EP andFullsix Spain’s control, EP andFullsix Spain will rectify any such fault as soon as it reasonably can.

These terms and conditions shall be governed by and construed in accordance with the Dutch substantive law. Any controversies that can be derived from the interpretation or execution of these terms and conditions shall be expressly submitted to the Courts and Tribunals of the Netherlands, and the user expressly waives any other jurisdiction that may correspond to him/her.
